Terms and conditions
Check the rental terms before booking; they explain your duties, payments and returns.
Renting a car
Draft. This text is being reviewed by a lawyer and may change before we launch. Parts in [square brackets] are still to be filled in.
1. Who rents to you
[COMPANY LEGAL NAME] ("we", "us") arranges the rental of cars that belong to independent owners and are leased to us for set periods, or that belong to a partner business. Your rental contract is with us. You may use the car only as these terms allow.
2. Who may rent
- You must be at least [23] years old and have held a full driver's licence valid in Nigeria for at least [2] years.
- Your licence must stay valid until the car is returned. We may check it with the official records, with your agreement, when you collect the car.
- The person who booked is the main driver. Anyone else who drives must be named, hold a valid licence, and be approved by us.
3. Booking and price
- The price shown before you pay includes every charge for the period and extras you chose, plus a refundable deposit.
- A rental day is 24 hours from pick-up, with 60 minutes' grace. If you return the car late, we charge by the hour, calculated to the second from the end of the 60-minute grace period until the car is handed back to our agent at the agreed airport, at the late rate shown in your booking (by default one and a half times the daily price divided by 24, per hour). The charge is taken from your deposit first; if it is more than the deposit you pay the balance through the link we send you.
- Your booking is confirmed when your payment succeeds. A car is held for [20] minutes while you pay.
4. Deposit
- A refundable deposit is held from you. We return it as soon as our agent has checked the car at hand-back (your bank can take 5 to 10 working days to show it), less any amount you owe for damage, fuel, fines, tolls, cleaning, late return or missing items, with a written explanation.
5. Changing or cancelling
- Cancel before pick-up: with 12 hours or more notice you receive a full refund of the rental price; with 6 to 12 hours' notice, 95% of it; with less than 6 hours' notice (or if the car is not collected), 90% of it. What is not refunded is a cancellation fee that we keep. The refundable deposit is always returned in full. Refunds go back to the card you paid with; your bank can take 5 to 10 working days to show them.
- Return the car early: tell us in your booking ("Return the car now") and hand the car back at the airport. We refund the unused time in proportion, calculated to the second from the pick-up time to the moment you tell us you are returning it (provided the car reaches us within 60 minutes), otherwise to the moment our agent receives it. One-off fees (such as the one-way fee) are not refunded. The refundable deposit comes back after our agent has checked the car.
- We may hold back part of the deposit for damage, missing fuel, fines or fees, with the reason shown to you in your booking.
- If we have to cancel (for example, the car is no longer available), you receive a full refund and we will help you find another car.
- Refunds go back to the card or account you paid with.
6. Collecting and returning the car
- Collect the car at the airport or place shown in your booking, with your ID and driver's licence. We inspect the car together and record its condition and fuel level in writing and photos.
- Return it to the agreed place, at the agreed time, with the same fuel level, clean, with its keys, papers and equipment. A one-way fee applies if you return it to another airport.
7. How you must use the car
- Use it lawfully and carefully. Do not drive under the influence of alcohol or drugs, race it, use it for hire or reward, carry more people than it has seats, tow, or take it out of Nigeria.
- Do not let an unapproved person drive it. Do not smoke in it.
- Keep it locked and the keys safe. Park it in a secure place at night.
8. Fines, tolls and offences
- You are responsible for all fines, tolls, parking charges and penalties during the rental. We may pass your details to the authorities and charge you an administration fee of [₦ amount] for each one.
9. Insurance and who pays for damage
- [Describe the cover: which insurer, what it covers, the excess you pay, and what it does not cover.]
- You are responsible for damage, theft or loss of the car and its contents during the rental up to [the excess / the full value] unless [conditions], and for all loss caused by breaking these terms.
- Tell us and the police straight away after any accident, theft or damage. Do not admit fault or agree a settlement.
10. Breakdowns
- If the car breaks down through no fault of yours, call [SUPPORT PHONE]. Do not have it repaired without our approval. We will arrange help or a replacement car where we can.
11. Ending the rental early
- We may take the car back, without refund, if you break these terms, the car is in danger, or we have a reasonable belief that it is being misused.
12. Our responsibility
- We are responsible for the car being roadworthy and as described when you collect it. We are not responsible for loss of your belongings, or for indirect loss such as missed flights, except where the law does not allow us to exclude it. Nothing in these terms limits your rights under Nigerian consumer law.
13. Your data
- How we handle your personal data, including identity checks, is explained in our privacy policy.
14. Complaints and the law
- Contact [SUPPORT EMAIL] first. If we cannot resolve a complaint, [the courts of Nigeria / arbitration in Abuja or Lagos] will decide. These terms are governed by the laws of the Federal Republic of Nigeria.
Buying a car
Draft. This text is being reviewed by a lawyer and may change before we launch. Parts in [square brackets] are still to be filled in.
1. How buying a car works
[COMPANY LEGAL NAME] ("we", "us") provides a marketplace where independent owners and businesses offer cars for sale. We are [an agent / an intermediary]; the sale contract is between you and the seller, and we hold your money in escrow until the car and papers are handed over.
2. Reserving a car
- You reserve a car by paying a non-trivial reservation deposit shown before you pay ([2]% of the price, at least ₦[50,000]).
- The car is held for you for [7] days. Only one buyer can hold a car at a time.
- If you do not pay the balance within the holding period, the reservation ends. [State what happens to the deposit: refunded in full / kept in part and why.]
3. Paying the balance
- Pay the balance by bank transfer to our escrow account shown in your order, using the reference given. Do not pay anyone else, in cash or otherwise, for this car. We confirm receipt when the money arrives.
- Your money stays in escrow. The seller is paid only after the hand-over is confirmed.
4. Inspection and the car's description
- Every car is checked by our team before it is listed, but you should inspect it and may have it checked by your own mechanic before you pay the balance.
- The listing states the price, mileage, condition, accident history and origin (Nigerian used, foreign used with customs duty paid, or new). We take reasonable steps to check these. If the car is materially different from its description, you may cancel and are refunded in full.
5. Hand-over and papers
- The seller hands over the car, its keys and the documents needed to register it in your name: [list: proof of ownership, customs papers, vehicle licence, roadworthiness, deed of sale]. We help to check them.
- You and the seller sign a record of the hand-over. When it is confirmed, we release the money to the seller, less our fee.
- Registering the car in your name is [your responsibility / handled with our help].
6. If something goes wrong
- If the seller cannot hand over the car or the papers within [7] days after the balance is paid, or the papers are not genuine, you are refunded in full from escrow.
- If you refuse to complete the purchase without a valid reason after paying the balance, [state the consequence].
- We decide disputes about escrow money fairly, on the evidence, and will tell you how.
7. Fees
- You pay the price shown and nothing more to us. The seller pays our fee out of the price.
8. Identity and fraud prevention
- We may ask you to prove who you are, and we may refuse or cancel a sale and report it to the authorities if we suspect fraud or money laundering. [Describe the checks required by law for car sales.]
9. Your data and the law
- See our privacy policy. These terms are governed by the laws of the Federal Republic of Nigeria; disputes go to [the courts of Nigeria / arbitration].
